MJ POINTS TERMS OF USE

Welcome to MJ Points, operated by Loyalty Rewards Enterprises Inc. (along with our affiliates, referred to as “MJ Points” “we,” or “us”). MJ Points is on a mission to be your go-to cannabis loyalty rewards program, anytime and anywhere in the United States and Canada. Our goal is to achieve this through the MJ Points mobile app (the “App”), any of MJ Point’s services (the “Services”), the www.mjpoints.app website, and any other associated websites or pages where our Terms of Use (the “Terms”) are displayed and accessible (collectively, the “Website”) (together, the Website, App, and Services are the “MJ Points App”).

  1. Acceptance of these Terms.

These Terms outline your rights and responsibilities as a user (the “User”, “you” or “your”) of the MJ Points App. The Terms, including all terms, conditions, and policies referenced here, along with any legal notices published within the MJ Points App, form the entire agreement between you and MJ Points regarding the MJ Points App.

By creating an MJ Points account, whether through a mobile device, mobile application, or computer, or otherwise using the MJ Points App in any manner, you agree to these Terms, including any additional terms and conditions and policies referenced herein or available by hyperlink. If you do not agree to the Terms, you are not allowed to use the MJ Points App.

We reserve the right, at our discretion, to change, modify, add or remove portions of the Terms or any such additional terms and conditions or policies at any time, and we will post the Terms. Please check these Terms and any such additional terms and conditions or policies referenced herein periodically for changes. Your continued use of the MJ Points App following the posting of changes to the Terms or any such additional terms and conditions or policies referenced herein will mean you accept those changes.

  1. Eligibility.

The MJ Points App is offered and available to users who are 21 years of age or older, or of legal age to contract, whichever is older. Users must also reside in (i) the United States or any of its territories or possessions and (ii) Canada.

By creating an account and using the MJ Points App, you represent and warrant that:

  • you are of legal age to form a binding contract with MJ Points;
  • you are not a person who is barred from using the MJ Points App under the laws of the United States, Canada or any other applicable jurisdiction;
  • you will comply with these Terms and all applicable local, state, national and international laws, rules and regulations, including without limitation, privacy laws, intellectual property laws, anti-spam laws, and regulatory requirements;
  • you have not committed, been convicted of, or pled no contest to a felony, a sex crime, or any crime involving violence or a threat of violence, unless you have received clemency for a non-violent crime and we have determined that you are not likely to pose a threat to other users of the MJ Points App, and that you are not required to register as a sex offender with any state, federal or local sex offender registry;
  • you do not have more than one account on the MJ Points App, and
  • you have not previously been removed from the MJ Points App by us, unless you have our express written permission to create a new account.
  • you specifically and unequivocally confirm and acknowledge that MJ Points, whether by itself or via the MJ Points App, does not sell or provide any cannabis related products.

If, at any time, you do not meet all of these requirements, your authorization to use the services is immediately revoked, you must not access or use the MJ Points App, and you must immediately delete your account.

  1. User Accounts and Access to the MJ Points App.

In order to use the MJ Points App, you will be required to create an account with us. Each user that creates such an account must (i) personally provide true, accurate, current and complete information on the applicable registration form (collectively, the “Registration Data”) and (ii) maintain and promptly update the Registration Data as necessary to keep it true, accurate, current and complete. For the avoidance of doubt, you will not be allowed to connect to the MJ Points App using a third-party social networking service (such as Facebook).

A user may receive passwords and account designations upon creating an account and is wholly responsible for maintaining the confidentiality of such passwords or designations. You must not disclose it to any other person or entity. You also acknowledge that your account is personal to you and agree not to provide any other person with access to the MJ Points App using your passwords and account designations. You agree to notify us immediately of any unauthorized access to or use of your account or any other breach of security. You also agree to ensure that you exit from your account at the end of each session. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information.

By using the MJ Points App, you are being provided a limited, non-exclusive, non-transferable, revocable license to download and install one (1) copy of the App on your device, and access and use the MJ Points App for personal, non-commercial purposes. You agree not to: (i) copy, modify, or distribute the MJ Points App for any reason; (ii) transfer, sublicense, lease, lend, rent, or share the MJ Points App with anyone; (iii) reverse-engineer, decompile, or create derivative works of the MJ Points App; (iv) make the MJ Points App’s functionality available to multiple users in any way; (v) use multiple accounts on one device; (vi) use the MJ Points App unlawfully or against the Terms; or (vii) use, copy, adapt, modify, create derivative works, distribute, license, sell, transfer, publicly display, perform, transmit, stream, broadcast, or otherwise exploit the MJ Points App, except as allowed in the Terms. No other licenses or rights are granted to you by implication or under any intellectual property rights owned by MJ Points or its licensors.

  1. Loyalty Program.
  1. How to Earn MJ Reward Points:

MJ Point’s in-app currency is referred to as “MJ Reward Points,” which functions similarly to reward points. You can earn MJ Reward Points and other rewards through various methods specified below, such as purchasing cannabis related products in physical stores, posting or promoting social media posts, scanning purchase receipts, and other activities outlined in these Terms, the MJ Points App or by MJ Points on social media (collectively, the “MJ Points Rewards Program”). MJ Points reserves the right to change, add, or remove any types of rewards and the methods by which members can earn and redeem MJ Reward Points or other awards, at any time and without prior notice. All MJ Reward Points, under all programs, are rewarded on a “first come, first served” basis. Eligibility requirements for the MJ Points Rewards Program and all programs may change without prior warning. Be sure to check the App or relevant pages within the MJ Points App for the most up-to-date information. MJ Points will not be liable for a failure to award MJ Reward Points or other rewards under any circumstances, for any reason, including errors in your mobile device or mobile network, failure to complete the actions, failure to follow the stated directions, or inaccuracies or illegibility of the receipt submitted. MJ Points cannot guarantee that participating products will always be available for purchase at the listed locations (e.g., a vendor may pull products from its shelves, or a product may be out of stock), or that eligibility dates will not change without prior warning. MJ Points disclaims all responsibility for any failure to award MJ Reward Points.

By using the MJ Points App and participating in the MJ Points Rewards Program, you agree that MJ Points is under no obligation to notify you if MJ Reward Points are no longer available.

  1. Applicable Limitations.

To ensure fair participation and prevent misuse of the rewards system, MJ Points has established daily and monthly earning and redemption limits:

  • Maximum MJ Points Earned Per Day: 1,000 MJ Points, including points from receipt claims, social media actions, referrals, and QR code scans.
  • Maximum MJ Points Earned Per Month: 20,000 MJ Points across all earning methods.
  • Maximum Redemption Per Day: 10,000 MJ Points can be redeemed for rewards within a 24-hour period.
  • MJ Points Expiration: Points must be used within 24 months from the date they are earned, or they will expire.

These limits are subject to change at MJ Points’ sole discretion and may be updated from time to time. Users should review the Terms regularly for any modifications or additional restrictions that may apply.

  1. Earning MJ Reward Points from Receipts from Online and In-Person Purchases:

The MJ Points App allows users to earn 1 MJ Point per $1 spent on cannabis-related purchases at participating dispensaries and eligible online retailers that legally sell cannabis products for pickup and delivery. Users may submit one receipt claim per twenty-four (24) hours, and all receipts must be submitted within fourteen (14) days of the purchase date to qualify for MJ Points. All receipts (whether in pdf format, confirmation email or otherwise) should be sent to claim@receipts.mjpoints.com.

By using MJ Point’s online-purchase feature, you agree to the terms and conditions of each applicable participating merchant, card processor, card network, and/or card issuer (collectively, “Processors”). Additionally, you agree to the terms within the MJ Point App for the applicable Processors and our Terms as detailed herein. If you do not agree to all of the applicable Processors’ terms and conditions, then you may not use the links to such Processors’ website and make online-purchase on such website or earn MJ Rewards Points from this feature. From time to time, MJ Points may not receive valid, complete, or otherwise sufficient data relating to transactions from online purchases. These transactions will be handled by the applicable Processors rather than MJ Points. Under no circumstances will MJ Points be responsible for Processors’ errors, omissions, negligence, reckless or intentional acts, privacy or publicity rights violations, and/or security breaches, including any related notification obligations. Certain online-purchase transactions, or portions thereof, may not be eligible to receive MJ Reward Points, including but not limited to clearance items, gift cards, tax, and shipping & handling fees. At MJ Point’s sole discretion, entire online-purchase transactions may be determined to be ineligible for MJ Reward Points or only eligible for partial MJ Reward Points credit. Rewards from online purchases may not be awarded or used until a specific time period has expired (for example, to account for returns associated with the participating merchant). Typically, this is between 30 and 45 days, but it could be longer, as indicated in the applicable section of the App and MJ Points App. If you make a return, the transaction is invalidated, disputed, or does not settle for any reason, then some or all pending MJ Reward Point will be decremented from your account, as determined at the sole discretion of MJ Points. If you make a return for cash, store credit, or credit to a different credit card, we will still need to deduct some or all of your pending MJ Reward Points accordingly. Regardless of our online-purchase offerings, MJ Points shall not be responsible for any online shopping transactions that you make, or attempt to make, using the online-purchase capability of the MJ Point App. For any questions or issues with any such online transaction, please contact the participating merchant, Processors, and/or your card issuer directly.

  1. MJ Reward Points for Scans:

With our MJ Reward Points for Scans program, you can earn MJ Reward Points by using the App’s scanning feature and your device’s camera to scan barcodes of participating products while in eligible stores. Additionally, users can earn bonus MJ Points by scanning QR codes found on product packaging or at participating venues as part of special brand promotions. MJ Points will notify you through the App or via email about which products and QR codes are eligible and where they can be found.

There are limits on how frequently and how many times you can scan each product or QR code within different time frames (daily, weekly, monthly, etc.). Each scan, whether of a barcode or QR code, contributes toward your daily and monthly MJ Points earning limits. Additionally, there’s a cap on the total number of scans per product or QR code across all users; once this limit is reached, MJ Points will no longer be awarded for scanning that product or QR code.

By participating, you agree to allow the App to access your camera and for MJ Points to review your scans. You also agree to use the MJ Reward Points for Scans program only for legitimate scans, in accordance with the Terms. Scans must be performed only at specified locations unless MJ Points provides other instructions. MJ Points does not guarantee that all advertised products or QR codes will always be available for scanning at listed locations, nor can we guarantee barcode accuracy. As such, MJ Points is not responsible for any failed scans or errors.

  1. Social Media Engagement Rewards Program:

Earn MJ Reward Points by engaging with MJ Points on Instagram through our Hashtag & Share Rewards Program. Due to the technical nature of our integration and restrictions on cannabis promotion across social media platforms, rewards are currently available only for tagging and following MJ Points on Instagram.

  • Tag MJ Points on Instagram: Earn +50 MJ Points for creating a public post that includes the official #MJPoints hashtag and tags @MJPoints.
  • Tag MJ Points + a Brand on Instagram: Earn +50 MJ Points when you tag both @MJPoints and an eligible brand in your post.
  • Follow MJ Points on Instagram: Earn a one-time bonus of +50 MJ Points when you follow @MJPoints on Instagram.

All posts must comply with Instagram’s platform policies and MJ Points’ Terms. Posts must not contain any misleading, offensive, or inappropriate content. MJ Points reserves the right to determine eligibility and may impose frequency limits on earning MJ Reward Points through social media participation. Check the MJ Points App for the latest requirements and updates.

  1. Referral Program.

Our MJ Points Referral Program rewards both you and your friends for spreading the word about MJ Points! When you refer a friend, you’ll earn 150 MJ Points once they successfully sign up and complete their first receipt scan.

As a bonus, the referred friend will also receive 150 MJ Points upon successful registration and their first receipt claim.

Referral bonuses are subject to MJ Points’ daily and monthly earning limits, as well as other specific limitations outlined in the Terms. MJ Points reserves the right to modify or discontinue the Referral Program at any time.

  1. Redeeming Your Rewards:

Redeeming your MJ Reward Points is simple and rewarding. Once you have accumulated enough points, you can exchange them for gift cards, discounts, or other rewards available in the MJ Points App. All redemptions are final, so be sure to select your reward carefully. MJ Reward Points have no cash value, are non-transferable, and cannot be sold, assigned, or exchanged for cash. Rewards are subject to availability, and MJ Points reserves the right to modify or discontinue reward options, adjust point values, or impose redemption thresholds at any time without prior notice. Some rewards may require additional processing time for fulfillment, and all redemptions are subject to the terms and conditions of the reward provider. MJ Points is not responsible for the fulfillment, condition, or value of any rewards provided by third parties, and any issues with a redeemed reward must be addressed directly with the supplier. Additionally, users are responsible for any applicable taxes on redeemed rewards. Check the MJ Points App regularly for the latest reward offerings, expiration dates, and any updates to the redemption process.

  1. Reward Requirements:

Certain rewards may require a unique code for redemption, such as a virtual store card, which may be sent to you via email, directly to your device, or through the MJ Points App. The email will be sent to the address you provide, and you may need to present the code to a store associate to redeem your reward. Once issued, the redemption process and the reward itself are handled by the merchant, and MJ Points is not responsible for the reward’s value or fulfillment. Some rewards may require an account with a third-party provider, such as PayPal or Venmo, a valid mailing address for shipping, or other requirements specified in the MJ Points App. It is your responsibility to ensure your account information is accurate and up to date. If a reward is not delivered, deposited, or redeemed due to an issue outside of MJ Points’ control, we are not obligated to reissue it. Merchandise rewards that cannot be claimed in-store or through the App will be shipped within six to eight weeks to an eligible U.S. or Canadian address. Some merchandise may require a physical street address for shipment. If a reward becomes unavailable, MJ Points reserves the right to substitute it with an item of equal or greater value or refund the MJ Reward Points used for redemption. All rewards are provided “AS IS”, without warranties of any kind, express or implied. Users must comply with all applicable laws when redeeming rewards and abide by MJ Points’ terms. MJ Points reserves the right to retroactively revoke any rewards obtained through prohibited conduct or policy violations. If you believe MJ Reward Points were not properly accrued, you must notify MJ Points within thirty (30) days of the error. Please allow thirty (30) days for review, as MJ Points’ decision on reward eligibility will be final. Technical issues or verification failures may prevent the successful accrual of MJ Reward Points, and MJ Points is not responsible for any lost or uncredited points due to system errors or third-party processing delays.

  1. Modification of the MJ Points App.

MJ Points reserves the right to modify, discontinue, or terminate any aspect of the MJ Points App at its sole discretion. This includes changes to these Terms, adjustments to the MJ Reward Points program, or the introduction of fees for certain services. MJ Points may also devalue or modify reward point balances, both retroactively and going forward, or discontinue the MJ Points App entirely. Any updates to these Terms will be posted within the MJ Points App, on our website, or communicated through other official channels. Revised terms will take effect immediately upon posting, or as soon as legally permitted, and will apply to all users regardless of account status. If any modification to the Terms or the MJ Points App is unacceptable to you, or if it results in non-compliance with the Agreement, you must discontinue use and, if necessary, terminate your account. In such cases, MJ Points reserves the right to revoke any unredeemed MJ Reward Points and associated rewards after providing prior notice. By continuing to access or use the MJ Points App after changes take effect, you acknowledge and agree to be bound by the updated Terms.

  1. Termination or Cancellation of Your Account.

You may terminate your MJ Points account at any time by deleting your account through the MJ Points App or submitting a written request to our support team at info@mjpoints.com. Once your account is canceled, it will become inaccessible, and all MJ Reward Points, awards, and unredeemed rewards will be forfeited. MJ Points will process termination requests within thirty (30) days of receipt. MJ Points reserves the right to immediately terminate or suspend your account, restrict your access to the MJ Points App, or remove any associated content if you violate these Terms, engage in fraudulent or improper conduct, or breach any applicable policies, all at our sole discretion and without prior notice. Termination may also result in disqualification from future participation in MJ Points programs. Any suspension, termination, or cancellation does not affect your obligations under these Terms, including those related to indemnification and limitation of liability, which will survive account termination. Upon termination, all licenses and rights granted to you under these Terms will immediately cease, and you will forfeit any accumulated MJ Reward Points or pending rewards. MJ Points will not be liable for any losses resulting from account termination or restriction. If your account is inactive for one hundred eighty (180) days or more, MJ Points may, at its sole discretion and without notice, deem the account inactive and terminate it, resulting in the forfeiture of all MJ Reward Points and associated rewards. Similarly, if MJ Reward Points are not used or redeemed within one hundred eighty (180) days of being awarded, they may be subject to expiration and forfeiture. We are committed to maintaining a fair and rewarding experience for all users. If you have any questions or concerns about your account, please contact our support team at info@mjpoints.com.

  1. Content Ownership MJ Points Content.

The MJ Points App contains various forms of content, including text, software, scripts, graphics, data, images, sounds, music, videos, interactive features, user-generated content, and other materials (collectively, “Content”). All trademarks, service marks, and logos displayed within the MJ Points App are either owned by or licensed to MJ Points. The Content, whether copyrighted, trademarked, or otherwise protected, is provided solely for your personal, non-commercial use in accordance with these Terms.

Additionally, the MJ Points App may feature descriptions and information about products and services offered by third-party retailers. However, MJ Points does not control these third parties, and availability, pricing, and selection may vary by retailer and location. While we strive to ensure accuracy, all Content is provided “AS IS”, and MJ Points makes no guarantees regarding its accuracy, reliability, or completeness. Users acknowledge that information displayed within the MJ Points App may sometimes be outdated, incomplete, or contain errors, and MJ Points assumes no liability for any inaccuracies.

  1. User Generated Content.

Certain sections of the MJ Points App may allow you to post or upload text, images (such as receipts or scans), graphics, and other content (“User Content“) for display or publication. By submitting User Content to MJ Points, you grant us a worldwide, perpetual, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, create derivative works of, display, and publicly perform the User Content in connection with MJ Points’ services. This includes, but is not limited to, promoting and redistributing MJ Points across various media platforms. Depending on your settings and the relevant third-party network policies, User Content submitted to the MJ Points App may also be viewed and shared by others, including on external social media platforms.

Any feedback, comments, or suggestions you provide regarding the MJ Points App (“Feedback“) will become the sole and exclusive property of MJ Points, and you irrevocably assign all rights, titles, and interests in such Feedback to us.

When submitting User Content, you agree not to upload material that infringes on intellectual property, privacy, confidentiality, or publicity rights, nor content that is false, misleading, unlawful, obscene, defamatory, threatening, harassing, hateful, or otherwise inappropriate. You further agree not to post advertisements, spam, chain letters, or impersonate another person.

MJ Points does not endorse or take responsibility for any User Content and expressly disclaims any liability arising from it. We reserve the right to determine, at our sole discretion, whether submitted User Content violates these Terms. MJ Points may remove such content at its sole discretion and suspend or terminate your access to the MJ Points App without prior notice if you violate these Terms. We will fully cooperate with law enforcement or legal requests to disclose the identity of users who violate applicable laws or these Terms through their posted User Content.

  1. SMS and Text Communications.

By providing your mobile phone number to MJ Points, you expressly consent to receive text messages from us, including promotional content, service updates, alerts, and other relevant communications related to our platform. Standard messaging rates and fees imposed by your mobile service provider may apply to both messages sent to you and any responses you send to us.

If you wish to opt out of receiving text messages, you can do so at any time by replying “STOP” to any message. Upon sending “STOP,” you may receive a confirmation message verifying that you have been unsubscribed. Once processed, you will no longer receive text messages from that specific program or short code. However, if you are subscribed to multiple text programs, you may continue to receive messages from other subscriptions unless you opt out of them individually.

  1. Links and Social Media Features. 

The Services may provide links to other websites and resources maintained by third parties. These links are provided for your convenience only. This includes links contained in advertisements, including banner advertisements and sponsored links.  MJ Points exercises no control whatsoever over such other websites and is not responsible or liable for the availability, content, advertising, products, services or other materials on such websites. Your access and use of such linked websites, including information, material, products and services therein, is solely at your own risk and subject to the terms and conditions of use for such websites.

You may link to our pages of the Services, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval, or endorsement on our part without our express written consent.

The Services may provide certain social media features that enable you to:

  • Link from your own or certain third-party websites to certain content on the Services.
  • Send emails or other communications with certain content, or links to certain content, on the Services.
  • Cause limited portions of content on the Services to be displayed or appear to be displayed on your own or certain third-party websites.
  • You may use these features solely as they are provided by us and solely with respect to the content they are displayed with, and otherwise in accordance with any additional terms and conditions we provide with respect to such features. Subject to the foregoing, you must not:
    • Establish a link from any website that is not owned by you.
    • Cause the Services or portions of it to be displayed on, or appear to be displayed by, any other site, for example, framing, deep linking, or in-line linking.
    • Link to any part of the Services other than the homepage.
    • Otherwise take any action with respect to the materials on the Services that is inconsistent with any other provision of these Terms.

The website from which you are linking, or on which you make certain content accessible, must comply in all respects with the content standards set out in these Terms.

You agree to fully cooperate with us in causing any unauthorized framing or linking immediately to stop. We reserve the right to withdraw linking permission without notice.

We may disable all or any social media features and any links at any time without notice in our discretion.

  1. Copyright.

MJ Points respects the intellectual property rights of others and requires all users of the MJ Points App to do the same. We have a policy of responding promptly to claims of copyright infringement and taking appropriate action when necessary. If you believe that your copyrighted work has been copied and made available on the MJ Points App in a way that constitutes copyright infringement, you may submit a written notice to our Designated Agent with the following information: (i) your electronic or physical signature, or that of a person authorized to act on your behalf; (ii) identification of the copyrighted work you claim has been infringed; (iii) identification of the allegedly infringing material, including sufficient details to allow MJ Points to locate it (such as a full URL or description); (iv) your name, address, telephone number, and email address; (v) a statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law; and (vi) a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

If you believe your content was removed or access to it was disabled in error, and that you have the right to use the material under copyright law or with authorization from the copyright owner, you may submit a counter-notice to our Designated Agent with the following: (i) your physical or electronic signature; (ii) identification of the material that was removed or disabled, including its prior location before removal; (iii) a statement that you have a good faith belief that the material was removed or disabled due to mistake or misidentification; (iv) your name, address, telephone number, and email address, along with a statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located, or if outside the United States or Canada, any judicial district in which MJ Points operates; and (v) a statement that you will accept service of process from the original complaining party.

If a valid counter-notice is received, MJ Points will send a copy to the original complainant, informing them that the removed content may be restored or access re-enabled within ten (10) to fourteen (14) business days, unless the copyright owner files a court action to prevent reinstatement. MJ Points reserves the right to determine, at its sole discretion, whether to restore the content.

  1. Communications Between You and MJ Points.

By using the MJ Points App, you acknowledge and agree that MJ Points may collect, use, and disclose certain information about you. This information may be provided by you directly, collected through your interactions with the MJ Points App, obtained from our service providers, or received from friends who invite you to join MJ Points. We may use this information to communicate with you through various channels, including the MJ Points App, our website, phone calls, text messages, emails, physical mail, or other electronic means to inform you about updates, new features, promotions, or other relevant services. Any such communication is considered a “Message”, and you agree that electronic messages from MJ Points satisfy any legal requirements for written communication.

You may receive various types of messages on your mobile device, including push notifications, text messages, picture messages, alerts, and emails, both within and outside the MJ Points App. By agreeing to these Terms and providing your consent, you authorize MJ Points to send text messages or make calls to your phone, including through an autodialer or prerecorded voice. Standard messaging rates and fees from your mobile carrier may apply.

We may also offer you the option to invite friends to join MJ Points through various methods such as SMS, email, social media platforms (e.g., Facebook, Instagram, X), or other communication tools. If you choose to send an invitation, you confirm that the recipient has consented to receive such messages and does not consider them unsolicited or unwanted. Additionally, you acknowledge that you have chosen to send these invitations voluntarily. While we may suggest message content for invitations, you can modify the message as needed before sending it. MJ Points is not responsible for sending these invitations on your behalf; if you choose to invite others, you do so at your own discretion.

You have control over the types of Messages you receive and can manage your preferences through the MJ Points App settings or your mobile device’s notification controls. However, MJ Points reserves the right to send you important service-related communications, including updates to our Terms, Privacy Policy, or other essential account-related notifications, even if you opt out of marketing messages.

The MJ Points App operates exclusively within the United States and Canada, and all data collection, processing, and storage are governed by U.S. and Canadian laws and regulations. By creating an account and using the MJ Points App, you expressly consent to the collection, storage, and processing of your submitted personal data in the United States and Canada. You may access and review your account information at any time to ensure its accuracy and update it as needed.

MJ Points is committed to protecting your privacy and respecting intellectual property rights. We employ automated tools to monitor and remove any content that violates our policies, and we reserve the right to disable access to such content when necessary.   1. Assignment.

We reserve the right to assign or transfer our rights and obligations under this Agreement. These Terms are personal to you and, as a result, you may not, without the written consent of MJ Points, assign or transfer any of your rights and obligations under this Agreement. There shall be no third-party beneficiaries to this Agreement.

  1. Disclaimer of Warranties.

MJ Points does not guarantee continuous, uninterrupted access to the MJ Points App or its services. The availability and performance of the MJ Points App may be affected by various factors beyond our control, including network congestion, service disruptions, third-party system failures, and unforeseen technical issues. When accessing the MJ Points App through a mobile device, you acknowledge that standard charges, data rates, and other fees imposed by your wireless carrier may apply. MJ Points assumes no responsibility or liability for any such charges.

We cannot and do not guarantee that your use of the MJ Points App will be free from errors, disruptions, viruses, or other harmful code. You are solely responsible for implementing appropriate security measures, such as using updated antivirus software and maintaining backups of your data. To the fullest extent permitted by law, MJ Points will not be liable for any loss or damage caused by distributed denial-of-service (DDoS) attacks, malware, viruses, or other harmful technology that may infect your device, software, or data due to your access to or use of the MJ Points App, including any downloads or links provided within the platform.

YOUR USE OF THE MJ POINTS APP AND ANY CONTENT, REWARDS, OR SERVICES OBTAINED THROUGH IT IS AT YOUR OWN RISK. THE MJ POINTS APP, INCLUDING ALL CONTENT AND SERVICES, IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. MJ POINTS DOES NOT GUARANTEE THE ACCURACY, RELIABILITY, SECURITY, OR AVAILABILITY OF THE MJ POINTS APP OR THAT ANY DEFECTS WILL BE CORRECTED. WE DO NOT WARRANT THAT THE PLATFORM WILL OPERATE ERROR-FREE, WITHOUT INTERRUPTION, OR IN A MANNER THAT MEETS YOUR SPECIFIC NEEDS OR EXPECTATIONS.

TO THE FULLEST EXTENT PERMITTED BY LAW, MJ POINTS EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE. NOTHING IN THIS PROVISION AFFECTS ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW

  1. Limitation of Liability.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MJ POINTS SHALL NOT BE LIABLE FOR ANY DAMAGES CAUSED UNINTENTIONALLY, NOR SHALL WE BE LIABLE FOR ANY ACTUAL, SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES, HOWEVER CAUSED. NOTHING IN THESE TERMS SHALL BE INTERPRETED AS LIMITING OR EXCLUDING LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW. IN PARTICULAR, MJ POINTS SHALL NOT BE LIABLE FOR: (I) LOSS OF REVENUE; (II) LOSS OF ACTUAL OR ANTICIPATED PROFITS; (III) LOSS OF USE OF FUNDS; (IV) LOSS OF ANTICIPATED SAVINGS; OR (V) LOSS, CORRUPTION, OR DAMAGE TO DATA, DEVICES, SYSTEMS, OR PROGRAMS, WHETHER ARISING IN CONTRACT, TORT (INCLUDING NEGLIGENCE AND STRICT LIABILITY), OR OTHERWISE, EVEN IF SUCH DAMAGES WERE FORESEEABLE OR KNOWN. BECAUSE SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS OR LIMITATIONS OF LIABILITY, SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE MJ POINTS APP, THE MJ REWARD PROGRAM, CONTENT, OR SERVICES, OR WITH ANY PROVISION OF THESE TERMS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO STOP USING THE MJ POINTS APP OR STOP PARTICIPATING THE MJ REWARDS PROGRAM. ALTHOUGH MJ POINTS WILL NOT BE LIABLE FOR LOSSES RESULTING FROM UNAUTHORIZED USE OF YOUR ACCOUNT, YOU MAY BE HELD RESPONSIBLE FOR DAMAGES INCURRED BY MJ POINTS OR OTHERS IF YOUR ACCOUNT IS USED IN VIOLATION OF THESE TERMS. IN NO EVENT SHALL MJ POINTS’ TOTAL AGGREGATE LIABILITY, ARISING FROM OR RELATING TO THESE TERMS OR THE USE OF OR INABILITY TO USE THE MJ POINTS APP, OR THE PARTICIPATION IN THE MJ REWARDS PROGRAM EXCEED THE AMOUNT YOU HAVE PAID TO MJ POINTS IN THE PAST 12 MONTHS OR TWENTY DOLLARS ($100 USD), WHICHEVER IS GREATER. THESE LIMITATIONS AND EXCLUSIONS OF LIABILITY FORM A FUNDAMENTAL ELEMENT OF THE AGREEMENT BETWEEN YOU AND MJ POINTS.

  1. Indemnification.

You agree to defend, indemnify, and hold harmless MJ Points, along with its affiliates, officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including but not limited to attorney’s fees) arising from: (i) your use of or access to the MJ Points App, Website, Content, or Services; (ii) your violation of these Terms; (iii) your infringement of any third-party rights, including, but not limited to, copyright, property, privacy, or confidentiality rights; or (iv) any claim that your User Content caused harm or damage to a third party. This indemnification obligation will survive the termination of these Terms, your account and your continued use of the MJ Points App, Website, Content, and Services.

The MJ Points App may include descriptions and promotional offers for products or services provided by third-party retailers and merchants. However, MJ Points does not control these third parties, and product availability, pricing, and selection may vary by retailer, store location, or online platform. Additionally, MJ Points may, from time to time, provide users with the opportunity to earn or redeem rewards with third-party providers. Any transactions, interactions, or engagements with such third parties are solely between you and the third-party provider, and their websites, platforms, and services are subject to their own terms and conditions, which you are responsible for reviewing and understanding.

MJ Points makes no warranties and assumes no liability for any third-party products, services, or rewards, including those purchased, redeemed, or earned through the MJ Points App. MJ Points does not endorse, guarantee, or take responsibility for the quality, accuracy, safety, legality, or fulfillment of any third-party goods or services. If you have any disputes, complaints, or issues regarding a third-party product or service, your sole recourse is to contact the third-party provider directly, not MJ Points

  1. Governing Law:

By using the MJ Points App, Website, Content, or Services, you agree that these Terms and any dispute that may arise between you and MJ Points shall be governed by the Federal Arbitration Act, applicable federal law, and the laws of the State of California, without regard to its conflict-of-law principles.

  1. Dispute Resolution – Arbitration Agreement; Waiver of Jury Trial:

If a dispute arises between you and MJ Points, our goal is to provide a neutral, efficient, and cost-effective resolution. Before initiating formal legal action, you agree to first contact MJ Points Customer Support to attempt to resolve the issue informally. If we are unable to resolve your dispute, you and MJ Points agree that any dispute, claim, or controversy arising from or related to these Terms, the MJ Points App, Website, Content, or Services shall be resolved through binding arbitration instead of in court, except that you may bring an eligible claim in small claims court if it qualifies. Additionally, both you and MJ Points retain the right to file a lawsuit solely for the purpose of protecting intellectual property rights or preventing unauthorized access, fraud, or abuse of the platform.

BOTH YOU AND MJ POINTS WAIVE ANY RIGHT TO A JURY TRIAL, AND AGREE THAT ANY ARBITRATION OR LEGAL DISPUTE SHALL BE CONDUCTED ON AN INDIVIDUAL BASIS—NOT AS A CLASS ACTION, COLLECTIVE ACTION, OR OTHER REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MULTIPLE CLAIMS OR PRESIDE OVER ANY FORM OF A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION WITHOUT THE EXPRESS WRITTEN CONSENT OF ALL PARTIES. THIS ARBITRATION AGREEMENT DOES NOT PREVENT YOU FROM BRINGING CONCERNS TO THE ATTENTION OF FEDERAL, STATE, OR LOCAL AGENCIES, WHICH MAY SEEK RELIEF ON YOUR BEHALF IF ALLOWED BY LAW. THIS ARBITRATION AGREEMENT SHALL SURVIVE THE TERMINATION OF YOUR ACCOUNT AND THE TERMINATION OF THIS AGREEMENT.

  1. Arbitration Process and Location:

To initiate arbitration, you must send a written demand for arbitration to MJ Points’ Legal Department at the address provided in the Contact Information section below. The arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as modified by this Agreement. The AAA rules and filing instructions are available at www.adr.org or by calling 1-800-778-7879.

Unless you and MJ Points agree otherwise, arbitration will be conducted in the county where you reside. If your claim is for $10,000 or less, the arbitration will be conducted solely based on documents submitted to the arbitrator, unless you request a hearing or the arbitrator determines that a hearing is necessary. If your claim exceeds $10,000, your right to a hearing will be governed by the AAA Rules. The arbitrator has the discretion to allow a reasonable exchange of information between both parties, consistent with the streamlined nature of arbitration.

  1. Arbitrator’s Authority and Decision:

The arbitrator shall render an award within the time frame specified in the AAA Rules and shall provide a written decision stating the essential findings and legal conclusions. Any judgment on the arbitration award may be entered in a court of competent jurisdiction. The arbitrator’s decision shall comply with the limitations set forth in the “Limitation of Liability” section of these Terms. The arbitrator may award declaratory or injunctive relief only to the extent necessary to resolve the individual claim at hand.

If you prevail in arbitration, you may be entitled to an award of attorneys’ fees and costs, as permitted by applicable law. MJ Points waives any right to seek attorneys’ fees or costs unless the arbitrator finds that your claim was frivolous or brought for an improper purpose.

  1. Arbitration Fees:

Your responsibility to pay any arbitration filing, administrative, or arbitrator fees will be governed by the AAA Rules. However, if your claim does not exceed $75,000, MJ Points will cover all arbitration-related fees unless the arbitrator determines that your claim was frivolous or brought in bad faith, as defined under Federal Rule of Civil Procedure 11(b).

If any portion of this Arbitration Agreement is found to be unenforceable, the remainder of the Agreement shall continue in full force and effect.

  1. Miscellaneous.
  1. Changes to These Terms:

Notwithstanding any other provision of these Terms, if we modify the Dispute Resolution section after the date you first accepted these Terms (or any subsequent revisions), you may reject the change by sending written notice to info@mjpoints.com  within thirty (30) days of the change becoming effective, as indicated by the “Last Updated” date or as communicated via email. If you choose to reject the modification, you agree that any dispute between you and MJ Points will be governed by the version of the Dispute Resolution section in effect at the time you first accepted these Terms (or the most recent version you accepted).

  1. Severability & Waiver:

If any provision of this Agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. Where possible, any invalid or unenforceable provision shall be modified or replaced with a valid and enforceable term that reflects the original intent as closely as possible.

Failure by MJ Points to enforce any provision of these Terms shall not be considered a waiver of our right to enforce the same provision or any other provision in the future. Similarly, any waiver of a specific breach or violation shall not be interpreted as a waiver of any subsequent breaches or violations.

  1. Entire Agreement:

These Terms, along with any referenced policies, legal notices published within the MJ Points App, and any official communications from MJ Points, constitute the entire agreement between you and MJ Points regarding your use of the MJ Points App, Website, and Services. This Agreement supersedes all prior and contemporaneous understandings or agreements, whether written or oral, unless expressly stated otherwise by MJ Points.
